The Backlog:

Delaware

In June 2015, Governor Jack Markell signed legislation that will improve handling of sexual assault cases. The legislation mandates the Department of Justice to oversee a statewide audit of all untested sexual assault kits, and also aims to improve rights of sexual violence victims through requiring law enforcement to receive victim-centered and trauma informed training.

In September 2015, the U.S. Department of Justice's Bureau of Justice Assistance announced the Executive Office of the Governor of Delaware was awarded $1,168,662 in funding to address its backlog through testing kits, investigating and prosecuting cases, and re-engaging victims.

On March 27, the Delaware Criminal Justice Council released a 3-page prelimiary audit report mandated by law that uncovered 1, 018 untested its in 22 police departments across the state. Seventeen departments reported not having any untested sexual assault kits in storage.
