In 2015, Delaware enacted a law requiring the state’s Department of Justice to conduct a one-time audit of untested rape kits. In 2016, the Delaware Criminal Justice Council found 1,033 untested kits in 22 police departments across the state. Seventeen departments reported not having any untested rape kits in storage. Delaware law does not require law enforcement agencies to track or test rape kits.

In 2015, the U.S. Department of Justice Bureau of Justice Assistance awarded $1,168,662 to the Delaware Governor’s office to test kits, investigate, and prosecute cases, and re-engage survivors.
